1. Terms of Use

This document sets out the Terms of Use ("Terms") of the Jollieri online store (the "Website").
The Website is operated by Jollieri ("the Seller", "we", "us", "our"), who is the owner of the Jollieri brand.
The customer ("you", "your") is a natural person of legal age who is not acting within the context of practicing a profession or conducting a business, with whom the Seller concludes an Agreement.
The Website is https://jollieri.com . The Product is a product that the Seller offers for sale on the Website. The Order is a purchase of one or more product(s) placed by the Buyer on the Website, in accordance with the procedure and terms described in this document. The Purchase Price is the price indicated on the Website for a Product.
By accessing this Website, you agree to be bound by these Terms. Before using this Website, you must always carefully read the Terms, as well as our Privacy Policy and Return Policy.

2. Applicability of the Terms of Use

These Terms of Use, made available online by Jollieri, govern the agreements and other legal relationships between the Seller and the Customer with respect to the use of the Website, including the purchase and sale of a product on or via the Website.

3. Order Placement and Completion Procedure

3.1 Order Placement

The Customer can place an order on or via the Website in the following manner: – The Customer selects the desired Product in the desired style, color, and size. – The Customer adds the Product to the cart. – The Customer checks their order and proceeds to checkout, filling in all personal and address details. – The Customer verifies the information provided. – The Customer selects a payment method and processes the payment. – The Customer receives a confirmation email for the Order that has been placed.
Please Note: This first confirmation email DOES NOT mean that the payment has gone through and that the order has been completed. If the email address provided is incorrect, Jollieri WILL NOT be able to send any confirmation emails or further information about the order and/or shipment.

3.2 Order Completion

After the Customer has placed an order, Jollieri will: – Check all order details. – Check if the address provided is correct (if it is not, our Customer Support will contact the Customer as soon as possible requesting a correct address). – Check if all ordered items are in stock (if there is any sold-out item, our Customer Support will contact the Customer as soon as possible offering a suitable solution). – Check if the payment has been processed and received. – Decide whether to accept or reject the order (see section 3.3 for further information about rejected orders).
If Jollieri decides to accept the order, the Customer will receive a confirmation email informing them that the order has been completed and will be processed and shipped as soon as possible.

3.3 Order Rejection

Jollieri will be entitled to reject the Order placed by the Customer in the following cases, among others: – If the information filled in by the Customer is incorrect, incomplete, and/or false, or if the Seller is reasonably entitled to doubt whether that is the case. – If the Customer's payment is not received. – If the Customer has previously failed to comply with their payment obligations towards the Seller. – If there is an obvious mistake or clerical error, for example, in the prices indicated on the Website. – If the Seller cannot deliver the Order to the address provided by the Customer.
If an Order is rejected, Jollieri will contact the Customer as soon as possible.

3.4 Conclusion of the Agreement

The Agreement, including the Privacy Policy and these Terms of Use, constitutes the entire agreement between the Customer and the Seller with respect to the use of the Website and the placement and execution of an Order.

4. Shipping and Delivery

4.1 Shipping

The Order is processed and shipped from the logistics as soon as possible after its completion.
Note: If Jollieri works with international suppliers or if products are shipped from a "Third country" (as in the original model), it is crucial to keep the customs responsibility clause. If this is not your case, this clause must be removed or adapted.
Customs Responsibility Clause (Keep if applicable): All our shipments and deliveries are made using a Third country. Jollieri is not responsible for any import charges, duties, taxes, or customs clearance that may occur. The Customer is always responsible for any import charges, duties, or taxes that may occur.
The risk with respect to any damage to or loss of the Products will be transferred to the Customer from the time the Products are delivered.

4.2 Shipping Address and Personal Information

The order will be shipped to the address indicated by the Customer, provided that the mentioned address is complete and correct. If the Customer provided incorrect and/or incomplete personal and address information, the Seller will have no responsibility for eventual delivery delays and/or failures.

5. Price and Payment

5.1 Prices

The prices indicated on the Website are denominated in the Customer's local currency. The total Purchase Price will be indicated in the Cart and in the confirmation emails.

5.2 Price Variation

The Seller will be entitled to adjust the prices indicated on the Website from time to time without any prior notice. The prices indicated at the time the Order is placed will be deemed to be the prices that form part of the Agreement.

5.3 Payment

Payment may be made using the methods indicated on the Website and must be made in advance for the Order to be fulfilled and the Agreement to be concluded.

6. Returns

If the Customer is not entirely satisfied with the purchase, they will be entitled to return the Product that has been delivered, at their own cost, within a period of 14 days after the Product has been received, without stating a reason, provided that the Product has not been used, is undamaged, and (as far as possible) is in the original and undamaged packaging.

Products purchased at a promotional or discounted price are NOT refundable. (This is a restrictive clause that must be verified if it is Jollieri's policy. If all products can be returned, this sentence must be removed).
Before returning products, the Customer must follow the return procedure indicated by the Seller on the Website (e.g., filling out a return form).

7. Complaints and Contact

7.2 Response Time

Our Customer Support will respond to all inquiries as soon as possible, within a period of 14 days after receipt, provided that the message has been received and that the indicated email address is correct.

7.3 Acceptable Deviations

The Customer acknowledges that minor variations and deviations that are generally considered acceptable with respect to the quality, size, color, finishing, etc., of the Products cannot be avoided or are difficult to avoid and do not constitute a well-founded reason to submit a complaint.

8. Warranty and Liability

8.1 Warranty

The Seller is required by law to provide a Product that meets the contract with the Customer.

The Customer must check the Product as soon as they receive it, before removing the tags and/or using the Product itself, and inform the Seller about any eventual defect within a period of 14 days.

8.2 Liability

The Seller is not liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of the Website.

9. Force Majeure

The Seller is not liable for any damage resulting from a delay in delivery or a failure to deliver that has been caused by circumstances that impede the Seller from complying with its obligations and that cannot be attributed to the Seller, such as war, riots, strikes, transport problems, trade limitations, customs issues, fire, flooding, bankruptcy of third parties involved, or other serious interruptions in business operations.

10.1 Website Browsing

Your use of and browsing on the Website are at your own risk.

10.2 Intellectual Property

The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Website are Registered Trademarks of Jollieri and others. Nothing contained on the Website should be construed as granting any license or right to use any Trademark displayed on the Website without the written permission of Jollieri.

You should assume that everything you see or read on the Website is copyrighted unless otherwise noted and may not be used, except as provided in these Terms of Use or in the text on the Website, without the written permission of Jollieri.
